Data Privacy Act of 2012

The Data Privacy Act of 2012 is the basic backbone of privacy law in the Philippines, and its enactment and implementation have played a significant role in protecting the privacy of individuals dealing with personal information or personal data. We are fully committed to complying with the Data Privacy Act of 2012 and its implementing rules and regulations. In this connection, in the event of a notifiable data breach, we will take the following actions:

We will notify you via email and/or phone within seventy-two (72) hours from our discovery of the notifiable personal data breach, in accordance with applicable laws. The notification will describe at least the nature of the breach, the personal information potentially involved, and the measures we have taken to address the breach.

This privacy policy has been created for those who are concerned about how AIFUL FINANCE PHILIPPINES INC. ("AIFUL," "we," "us," "our") processes Personal Information and Sensitive Personal Information.

We may collect your name, sex, birthdate, email address, address, phone number, and other details such as tax identification number, social security number, financial information, employment data, and identification documents, as needed. We also process your photographs, fingerprints, other biometric data (e.g., facial recognition, voice recognition), mobile usage data, financial profile, credit standing, and loan payment history.

Why Do We Collect Information?

The data we collect is primarily used to verify your identity and better understand your financing needs, allowing us to offer the most suitable financing options. We use personal information for the following purposes, among others:

  • Verifying your identity and any authority you may have to act on behalf of your business;
  • Ensuring compliance with applicable laws and regulations, including anti-money laundering requirements;
  • Reviewing and making decisions on your financing applications;
  • Enhancing customer service and engagement or providing ongoing support;
  • Managing billing, collections, and payments;
  • Refining our credit policy, operational processes, data analytics, and conducting market research;
  • Fulfilling our contractual obligations with you and our third-party partners;

The provision of your personal data is voluntary. However, if you do not provide, or withdraw your consent for us to use, your personal data, AIFUL may not be able to:

  • fulfill our contractual obligations to you.

Notwithstanding the withdrawal of your consent, AIFUL may still proceed to process your personal data using bases recognized and permitted under applicable laws.

How long do we retain Information?

In accordance with the Data Privacy Act of 2012, your personal data shall only be retained for as long as necessary to fulfill the purposes for which it was collected, or for legal, operational, or legitimate business purposes. Specific retention periods may include:

  • Loan and payment-related information: Retained for a defined period after loan closure to comply with legal and regulatory requirements.
  • Marketing and analytical data: Retained only as long as necessary for purposes of customer engagement or until you opt out.

What Are Your Rights as a Data Subject?

You have rights regarding your personal information under Philippine laws and regulations. These include the rights to be informed, access, correct, delete, restrict or object to our use of, or receive a portable copy in a usable electronic format of your personal information. You also have a right to lodge a complaint with the National Privacy Commission.

How Do We Protect Your Information?

AIFUL FINANCE PHILIPPINES INC. shall implement appropriate organizational, physical and technical security measures in order to ensure the privacy and protection of personal data in its possession. The security shall aim to protect and secure data from loss, misuse, unauthorized modification, unauthorized access or disclosure, alteration or destruction. The following are the company safeguards:

  • Strict implementation of information security policies
  • Access Restriction to unauthorized personnel
  • Use of secured servers and firewalls
  • Data encryption on computing devices

Disclosure to Third Parties

We do not sell, trade, or transfer your personal information to external third parties. Acts related to unauthorized processing, transfer, trading, or selling of information are illegal and punishable by law.
